Castro Valley Couple Sentenced to Prison, Community Service for Tax Fraud

Kevin M. Silva and Christine A. Silva falsely claimed $1,544,034 in tax refunds and agreed to repay the remaining outstanding balance of $535,581.13 to the IRS prior to sentencing.

From the U.S. Attorney’s Office, District of Arizona

A Castro Valley couple were sentenced to 24 months in prison and 100 hours of community service on Monday for tax fraud.

U.S. District Judge David G. Campbell sentenced Kevin M. Silva, 54, and Christine A. Silva, 67, after they falsely claimed $1,544,034 in refunds and agreed to repay the remaining outstanding balance of $535,581.13 to the IRS.

The payment was made via a cashier’s check on August 23, 2012. In the course of the investigation, the IRS was able to recover over $250,000 from the Silvas in addition to the payment.

They were ordered to self-surrender on Oct. 29, 2012. The Silvas each pleaded guilty to conspiracy to defraud the government with respect to false claims upon the United States and the actual presentation of a false claim upon the United States on June 4, 2012.

In the course of their prior guilty pleas, the Silvas admitted to conspiring and agreeing to participate in a scheme to obtain payment of false claims for refunds from the IRS by filing false federal income tax returns.

In each instance, the Silvas claimed refunds to which they knew they were not entitled. All of the fraudulent claims were based primarily upon representations that money had been withheld by various financial institutions on behalf of the couple during the subject tax years and that the couple was entitled to the claimed withholdings.

No such withholdings ever occurred. In support of each claim, the Silvas submitted to the IRS various false IRS Forms 1099-OID.

The Silvas admitted the following with respect to each return:

Tax Year Tax Payer Date Filed Amount Claimed Amount Paid by IRS 2005 Kevin M. Silva 7/1/2008 $559,172 $566,388 2005 Christine A. Silva 7/11/2008 $557,514 $0 2006 Christine A. Silva 9/2/2008 $130,346 $0 2006 Kevin M. Silva 9/3/2008 $153,501 $244,363 2007 Kevin M. Silva 9/4/2008 $143,501 $0

The investigation in this case was conducted by Internal Revenue Service-Criminal Investigation. The prosecution is being handled by Frederick A. Battista, Assistant U.S. Attorney, District of Arizona, Phoenix.

Another problem: When notified of a reply to a comment I could click the link in the email to go toRead More the article. That was not possible this time. So because a small minority zooms there computer the layout should be as it is? I don't think so. All that white space means that an article that could be read with just one or two clicks to scroll through is now going to take more scrolling to view. One thing that seems to be missing in today's world are web designers who (1) change the layout just because and (2) web designers who have neglected to consider the audience. The more I look at this layout the less I like it. The font needs to be darker than it is. the blue (like in "announcements") needs to be bolder. Overall, on a scale of 1 to 10 (10 best), I rank the new "improved" design a 3.
